What is a patio?
If you see an external structure attached to a house with a roof that you use as an outdoor entertaining area that is most likely a patio. Do not confuse this with a pergola. A pergola is also a structure attached to a house, but it does not have a roof. Once it has a roof it is a patio.
Once you close in the patio walls it becomes an extension to the house.

Different structures have different rules applied. If the attached patio structure is under 10sqm it does not need a building permit. This is called self-assessable building work. However, it has to be built to the building code.

If the structure is bigger than 10sqm it requires building approval. I would estimate 50% of patios I inspect would not have building approval as they are not built to code.
